Utilizzando MuseAuthor ("il Servizio"), accessibile all'indirizzo museauthor.com, accetti di essere vincolato dai presenti Termini di Servizio. Se non accetti questi termini, non utilizzare il Servizio.

2. Descrizione del Servizio

MuseAuthor è una piattaforma SaaS che consente agli utenti di creare, strutturare ed esportare libri per la pubblicazione su Amazon KDP (Kindle Direct Publishing) utilizzando tecnologie di intelligenza artificiale.

3. Account e Registrazione

Per accedere al Servizio è necessario creare un account tramite Google o email. Sei responsabile della sicurezza delle tue credenziali di accesso e di tutte le attività svolte con il tuo account.

4. Abbonamenti e Pagamenti

MuseAuthor offre piani di abbonamento mensile. I pagamenti vengono gestiti in modo sicuro. Il fornitore di pagamento agisce come Merchant of Record. I prezzi sono indicati in Euro e includono l'IVA applicabile. L'abbonamento si rinnova automaticamente ogni mese fino alla cancellazione.

5. Cancellazione

Puoi cancellare il tuo abbonamento in qualsiasi momento dal pannello di gestione account. La cancellazione ha effetto al termine del periodo di fatturazione corrente.

6. Natura del Servizio e Responsabilità Esclusiva dell'Utente sui Contenuti

MuseAuthor è esclusivamente uno strumento di assistenza alla scrittura. Funziona come un avanzato elaboratore di testi intelligente: suggerisce, corregge, struttura e propone bozze sulla base delle istruzioni dell'Utente. MuseAuthor non è un editore, non è un agente autonomo e non vende contenuti propri.

Sottoscrivendo il Servizio, l'Utente riconosce e accetta quanto segue:

6.1 Proprietà e Responsabilità dell'Input: L'Utente è l'unico responsabile dei dati, testi, istruzioni o file caricati sulla piattaforma (Input). L'Utente garantisce di possedere i diritti necessari per il loro utilizzo e che tali contenuti non violino leggi vigenti o diritti di terzi.

6.2 Proprietà e Responsabilità dell'Output: I contenuti generati dal Servizio sulla base delle istruzioni dell'Utente (Output) appartengono all'Utente. L'Utente assume la piena ed esclusiva responsabilità legale per la creazione, la modifica, la pubblicazione e la distribuzione di qualsiasi Output, inclusa — a titolo esemplificativo — la responsabilità per diffamazione, violazione del copyright, plagio, informazioni errate o qualsiasi danno a terzi.

6.3 Obbligo di Revisione Umana: L'Utente riconosce che i modelli di intelligenza artificiale possono generare informazioni imprecise, incomplete o non aggiornate ("allucinazioni"). È obbligo esclusivo dell'Utente verificare l'accuratezza, la correttezza legale e l'appropriatezza di ogni contenuto generato prima di qualsiasi utilizzo, pubblicazione o distribuzione. MuseAuthor non garantisce che i suggerimenti siano corretti, completi o adatti a uno scopo specifico.

6.4 Assenza di Controllo Editoriale: MuseAuthor non legge, non monitora e non supervisiona i contenuti creati dai propri utenti, così come un produttore di penne non è responsabile di ciò che viene scritto con le proprie penne, o come Microsoft non è responsabile di ciò che viene redatto in Word. La responsabilità editoriale e legale dell'Output ricade interamente sull'Utente.

6.5 Clausola di Manleva (Indemnification): L'Utente accetta di indennizzare, difendere e tenere indenne MuseAuthor (Soomoby di Ferrucci Alberto), i suoi collaboratori e fornitori da qualsiasi pretesa, danno, perdita, sanzione o spesa legale derivante da: (a) l'uso del Servizio da parte dell'Utente; (b) contenuti creati, pubblicati o distribuiti dall'Utente tramite o con l'ausilio del Servizio; (c) violazioni della presente Policy da parte dell'Utente.

6.6 Copyright dei Contenuti AI: L'Utente è informato che, secondo le attuali interpretazioni normative, i contenuti generati interamente da intelligenza artificiale senza significativo apporto creativo umano potrebbero non essere soggetti a tutela del diritto d'autore. MuseAuthor non garantisce che l'Utente possa rivendicare la proprietà intellettuale esclusiva sull'Output non rielaborato in modo significativo.

7. Politica di Utilizzo Accettabile (AUP)

Utilizzando MuseAuthor, l'Utente si impegna a non generare, richiedere o distribuire contenuti che:

— siano sessualmente espliciti, pornografici, osceni o per adulti (NSFW);
— rappresentino o promuovano violenza, odio, discriminazione o attività illegali;
— violino diritti di proprietà intellettuale di terzi;
— siano fuorvianti, diffamatori o fraudolenti;
— riguardino minori in contesti inappropriati;
— siano generati con l'intento di aggirare i sistemi della piattaforma.

MuseAuthor si riserva il diritto di sospendere o chiudere account che violino ripetutamente o gravemente la presente Policy, senza obbligo di rimborso. La responsabilità per i contenuti creati rimane in ogni caso esclusivamente dell'Utente.

8. Limitazione di Responsabilità Finanziaria

Nella misura massima consentita dalla legge applicabile, la responsabilità complessiva di MuseAuthor per qualsiasi reclamo non supererà mai l'importo pagato dall'Utente per l'abbonamento nei dodici (12) mesi precedenti all'evento contestato. In nessun caso MuseAuthor sarà responsabile per danni indiretti, perdita di profitti, perdita di dati o interruzione di attività derivanti dall'uso o dall'impossibilità di utilizzo del Servizio.

9. Limitazione di Responsabilità Generale

MuseAuthor non garantisce che il Servizio sia privo di errori o ininterrotto. In nessun caso Soomoby di Ferrucci Alberto sarà responsabile per danni indiretti, incidentali o consequenziali derivanti dall'uso del Servizio.

10. Modifiche ai Termini

Ci riserviamo il diritto di modificare questi termini in qualsiasi momento. Le modifiche saranno comunicate via email e/o tramite avviso nel Servizio.

By using MuseAuthor ("the Service"), accessible at museauthor.com, you agree to be bound by these Terms of Service. If you do not accept these terms, do not use the Service.

2. Description of Service

MuseAuthor is a SaaS platform that enables users to create, structure and export books for publication on Amazon KDP (Kindle Direct Publishing) using artificial intelligence technologies.

3. Account and Registration

To access the Service you must create an account via Google or email. You are responsible for the security of your login credentials and all activities carried out with your account.

4. Subscriptions and Payments

MuseAuthor offers monthly subscription plans. Payments are handled securely. The payment provider acts as Merchant of Record. Prices are stated in Euros and include applicable VAT. The subscription renews automatically each month until cancellation.

5. Cancellation

You may cancel your subscription at any time from the account management panel. Cancellation takes effect at the end of the current billing period.

6. Nature of Service and Exclusive User Responsibility for Content

MuseAuthor is exclusively a writing assistance tool. It functions as an advanced intelligent word processor: it suggests, corrects, structures and proposes drafts based on the User's instructions. MuseAuthor is not a publisher, not an autonomous agent and does not sell its own content.

By subscribing to the Service, the User acknowledges and agrees to the following:

6.1 Input Ownership and Responsibility: The User is solely responsible for data, texts, instructions or files uploaded to the platform (Input). The User warrants that they hold the necessary rights for their use and that such content does not violate applicable laws or third-party rights.

6.2 Output Ownership and Responsibility: Content generated by the Service based on the User's instructions (Output) belongs to the User. The User assumes full and exclusive legal responsibility for the creation, modification, publication and distribution of any Output, including — by way of example — responsibility for defamation, copyright infringement, plagiarism, misinformation or any damage to third parties.

6.3 Human Review Obligation: The User acknowledges that artificial intelligence models may generate inaccurate, incomplete or outdated information ("hallucinations"). It is the User's exclusive obligation to verify the accuracy, legal correctness and appropriateness of any generated content prior to any use, publication or distribution. MuseAuthor does not guarantee that suggestions are correct, complete or fit for a specific purpose.

6.4 Absence of Editorial Control: MuseAuthor does not read, monitor or supervise content created by its users, just as a pen manufacturer is not responsible for what is written with its pens, or as Microsoft is not responsible for what is drafted in Word. Editorial and legal responsibility for the Output rests entirely with the User.

6.5 Indemnification Clause: The User agrees to indemnify, defend and hold harmless MuseAuthor (Soomoby di Ferrucci Alberto), its collaborators and suppliers from any claim, damage, loss, penalty or legal expense arising from: (a) the User's use of the Service; (b) content created, published or distributed by the User through or with the aid of the Service; (c) violations of this Policy by the User.

6.6 Copyright of AI-Generated Content: The User is informed that, under current regulatory interpretations, content generated entirely by artificial intelligence without significant human creative contribution may not be subject to copyright protection. MuseAuthor does not guarantee that the User may claim exclusive intellectual property rights over Output not significantly reworked by human contribution.

7. Acceptable Use Policy (AUP)

By using MuseAuthor, the User agrees not to generate, request or distribute content that:

— is sexually explicit, pornographic, obscene or adult/NSFW in nature;
— depicts or promotes violence, hatred, discrimination or illegal activities;
— violates third-party intellectual property rights;
— is misleading, defamatory or fraudulent;
— involves minors in inappropriate contexts;
— is generated with the intent to circumvent the platform's systems.

MuseAuthor reserves the right to suspend or terminate accounts that repeatedly or seriously violate this Policy, without obligation to refund. Responsibility for created content remains exclusively with the User in all cases.

8. Financial Limitation of Liability

To the maximum extent permitted by applicable law, MuseAuthor's total liability for any claim shall never exceed the amount paid by the User for the subscription in the twelve (12) months preceding the disputed event. In no event shall MuseAuthor be liable for indirect damages, loss of profits, loss of data or business interruption arising from the use or inability to use the Service.

9. General Limitation of Liability

MuseAuthor does not guarantee that the Service will be error-free or uninterrupted. In no event shall Soomoby di Ferrucci Alberto be liable for indirect, incidental or consequential damages arising from the use of the Service.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be communicated via email and/or notice within the Service.
